Terms and Conditions

These terms govern access to Exampay's website, education-management service and separate Test Series product. By using the service, you agree to these terms. If you use Exampay for a school or organisation, you confirm that you are authorised to act for it. A school's signed service agreement, if any, may contain additional commercial terms; the signed agreement controls if there is a direct conflict.

1. Eligibility and authorised accounts

Accounts are role-based. School Programme accounts must be created or approved by an authorised school or Exampay administrator. A learner may create a separate Test Series account to use a free diagnostic or purchased test programme. Students who are minors may use either service only with the permissions required by law and their parent or lawful guardian. You must provide accurate information, use only your assigned role and tell us if your authority changes.

2. Account security

Keep access credentials, sign-in links and one-time codes confidential. Do not share accounts or bypass role restrictions. You are responsible for activity conducted through your account to the extent permitted by law. Notify info@exampay.in immediately of suspected compromise.

3. Permitted use

You may use Exampay only for legitimate education, administration and communication purposes authorised by your school. You must not:

• access another person's account or data, scrape the service, probe security without written permission, or defeat technical limits;
• upload malware, unlawful material, infringing content or unnecessary sensitive personal data;
• harass users, falsify academic, attendance, fee or payment records, or interfere with examinations;
• reverse engineer, resell or commercially exploit the service except as permitted by a written agreement; or
• use automated systems that overload or disrupt the service.

4. School and administrator responsibilities

Schools and administrators must authorise users, keep role assignments current, provide legally required notices and consents, verify academic and fee records, remove access when no longer required, and use appropriate retention and incident-response procedures. They must not place payment-card details, health records or other unnecessary highly sensitive information in free-text fields.

5. Assessments and academic records

Test timing and scoring are supported by server-side controls, but connectivity, device behaviour and human review can affect an assessment. Full-screen prompts cannot prevent operating-system shortcuts, secondary devices or all forms of misconduct. Schools remain responsible for assessment rules, supervision, accommodations, score review and final academic decisions.

6. Test Series access and examinations

Except for a programme expressly labelled free, Test Series access requires a verified payment or an administrator-approved enrolment. Access is personal, non-transferable and limited by the programme validity, published schedule and attempt limit shown at purchase or assignment. Starting an attempt may consume an allowed attempt even if the learner later closes the browser, loses connectivity or leaves full-screen mode. The server timer controls expiry. Scores and rankings are practice indicators only and do not guarantee performance, selection, admission or any official examination result. We may correct a scoring or content error after reasonable review.

7. Fees and payment records

The School Programme displays fee schedules and offline payment records; a marked-paid record or uploaded receipt is not conclusive proof of settlement and should be verified by the school. The separate Test Series may offer online checkout through an identified payment provider. Test Series access is granted only after server-side verification of the provider's payment confirmation; a browser return page or screenshot is not proof of payment. Charges, due dates, refunds and cancellations are governed by the applicable school or service agreement and our Refund and Cancellation Policy.

8. Content and intellectual property

Exampay and its software, design and branding are protected by applicable intellectual-property laws. Schools and users retain rights in content they lawfully submit and grant Exampay a limited permission to host, process, display and transmit it only to operate, secure and support the service. You confirm that you have the necessary rights to uploaded content.

9. Third-party services

Google, Supabase, Hostinger and other third-party services may have their own terms and privacy practices. Exampay is not responsible for a third party's independent service, but we remain responsible for our own obligations under applicable law and agreements.

10. Availability, changes and suspension

We aim to keep the service reliable but do not promise uninterrupted or error-free access. Maintenance, security incidents, network failures or events outside reasonable control may interrupt it. We may update features and may suspend access reasonably necessary to protect users, comply with law, address non-payment under an agreement or investigate misuse. Where practicable, we will provide notice.

11. Disclaimers and liability

To the maximum extent permitted by law, the service is provided on an "as available" basis and Exampay disclaims implied warranties that can lawfully be excluded. Exampay is not the school and does not make final academic, admission, disciplinary or fee decisions. Nothing in these terms limits liability or consumer rights that cannot legally be limited. For other claims, liability will be determined by applicable law and any signed service agreement.

12. Termination

You may stop using the service and may request account closure through your school or Exampay. We may terminate or restrict access for material breach, unlawful use, security risk or as provided in an applicable agreement. Provisions intended to survive—including ownership, payment obligations, disclaimers and dispute terms—continue after termination.

13. Governing law and disputes

These terms are governed by the laws of India. Subject to mandatory consumer forums and other rights that cannot be excluded, courts with jurisdiction in Gautam Buddh Nagar, Uttar Pradesh will have jurisdiction. Please contact us first so we can try to resolve a concern promptly.
